Consumer Protection Laws Explained : Practice & Procedures

 

Increase in trade, cut-throat competition coupled with the greed to be the first, has led manufacturers, sellers and service providers deliver poor quality products and services, often followed with unethical practices to run away from responsibility.

These formed the basis for “UN Guidelines on Consumer Protection” to be incorporated in our domestic legal framework in the form of Consumer Protection Act, 1986 which was the legal weapon protecting the consumers for over quarter of a Century.

Thereafter, the Globalization, increase in trade, emergence of new modes of dealings and supplies and e-commerce have created new options and opportunities for consumers, however, these very opportunities have made the consumer vulnerable to new forms of unfair trade and unethical business practices.

This necessitated the need to amend the existing framework of the Consumer Protection Act, 1986 to strengthen consumer interests and establish regulatory authority for timely and effective administration and settlement of consumer disputes in today’s age of digitization and rising e-commerce activities.

This overhaul was provided by the Consumer Protection Act, 2019, which addresses consumer concerns arising from technological advancements in the marketplace. The course takes the Act of 1986 as the building blocks upon which the Consumer Protection regime of India was established and from there it analyses the gaps that came to exist and how the repealing Act of 2019 plugs those gaps.

The course helps lawyers and law students get familiar with the detailed procedure to file a consumer grievance, process of approaching a Consumer Forum, detailed descriptions of laws that are applicable, accompanied illustrations and case studies to facilitate understanding.
