Decoding CrPC (A Comprehensive Course on Code of Criminal Procedure, 1973)

 

Criminal justice system is an apparatus that the society has designed for enforcing the prescribed standard of conduct. The said standard is necessary for the protection of the individual and the societal interests. In this respect, identification and definition of the "offence" committed along with the procedure for the administration of justice to the victim of the offence becomes paramount. The Course equips the learner with all the aspects of criminal procedural law, right from the time the police are intimated of the commission of an offence, the rules for investigation of a crime by the police, the conduct of criminal trials by the Courts in India for bringing the criminal delinquents to justice, to all the stages of a typical criminal trial, including the highest appellate stage viz. the Hon'ble Supreme Court of India.

The aim of this course is to cover the practical facets of the criminal justice delivery system in India as enshrined within the Code of Criminal Procedure, 1973. This course will illuminate the learner with the diverse procedures adopted by the Police and Judges regarding how to investigate and decide a matter arising out of a criminal doing. It also specifies the rights of an accused person with respect to the conduct of criminal trials.

  • Describe the basic procedures relating to FIRs, Complaint, Police Report, Inquiry, Search and Seizure, etc.;
  • Explain different kinds of Trials such as warrant case, summons case, and summary and their respective stages;
  • Assess provisions regarding the maintenance of wife, children and parents under the CrPC;
  • Critically analyze the overall Criminal Prosecution Procedure in India.

About the Author

Prof. (Dr.) Souvik Chatterji, is currently working as an Associate Professor (Law) and Head of Department (School of Juridical Sciences), JIS University, Kolkata. Having a PhD from National Law University, Jodhpur and LL.M.s from Warwick University and Case Western University, Cleveland, Dr. Chatterji has a decade of experience in teaching both graduate and post-graduate level students. He has authored eight text books (published by Thomson Reuters, South East Asia, YS Books International, India, Allahabad Law Agency, India) titled "Law of Crimes in India", "Competition Law in India", "Laws of Infrastructure Development in India", "Human Rights and Criminal Justice", "Competition Law in India and Cartels in India and USA", "Property law in India", to name a few, and 70 articles in Madras Law Journal, Company Cases, Institute of Peace and Security Studies and Consolidated Commercial Digest. He has worked as a researcher World Bank's and IMF's project on "Cases Relating to Money Laundering" under Professor Richard Gordon, Case Western University, Ohio. He has worked in CUTS International, CCIER, Jaipur, India and was a lecturer in WBNUJS, Kolkata for 4 years.
